Abaza language

The Abaza language (Абаза Бызшва, Abaza Byzšwa) is a language of the Caucasus mountains in the Russian Karachay-Cherkess Republic by the Abazins. It consists of two dialects, the Ashkherewa dialect and the T’ap’anta dialect, which is the literary standard.

Abaza is spoken by approximately 35,000 people in Russia, where it is written using a modified Cyrillic alphabet, as well as another 10,000 in Turkey, where the Roman alphabet is used.

Abaza, like its relatives in the family of Northwest Caucasian languages, is highly agglutinative and has a large consonantal inventory (63 phonemes) coupled with a minimal vowel inventory (two vowels). It is very closely related to Abkhaz, but it preserves a few phonemes which Abkhaz lacks, such as a pharyngeal voiced fricative. Work on Abaza has been carried out by W. S. Allen, Brian O’Herin, and John Colarusso.

There is no single law on bankruptcy in the United Kingdom with there being one system for England and Wales, one for Northern Ireland and one for Scotland.

Bankruptcy Law

There are two main personal insolvency regimes in the UK: one for England and Wales and another for Scotland. In England and Wales the majority of personal insolvencies are “bankruptcies”. The remainder are Individual Voluntary Arrangements or IVAs, which are arrangements between the debtor and his or her creditors for the payment of the debts on different terms: for example by instalments, or over a period of time. These two forms of insolvency have close equivalents in Scotland, where bankruptcies are known as sequestrations and the equivalent of IVAs are Protected Trust Deeds, or PTDs.

In bankruptcy, an indebted individual sees his debts forgiven in return for surrendering his assets (and sometimes a limited proportion of his income). He is allowed however to retain so-called “exempt” assets such as tools-of-trade and basic necessities and the generosity of this exemption level has received much attention in the USA where it varies among states, potentially affecting bankruptcy filing rates.

Bankruptcy is handled by a Trustee in bankruptcy who must be either the Official Receiver (a civil servant) or a licensed insolvency practitioner.

Following the introduction of the Enterprise Act 2002’s bankruptcy provisions in April 2004, an England & Wales bankruptcy will now normally last no longer than 12 months and may be less, if the Official Receiver files in Court a certificate that his investigations are complete. However, in cases where the bankrupt is considered particularly culpable for his or her insolvency, the bankruptcy can last for up to 15 years, although such orders are rare.


Why are bankruptcies soaring?

Some claim that the Enterprise Act threatens massively to increase the number of bankruptcy cases. Indeed, bankruptcies have risen considerably since the change. However they were already on an upward trend, and the rise is mirrored in Scotland, where there has been no legislation change.

A popular alternative explanation for the run-up in UK insolvencies is “destigmatisation” - people, it is said, are becoming less ashamed of going bankrupt. This is hard to prove, but some evidence is provided by figures showing that, increasingly, bankruptcy petitions are filed by debtors themselves, rather than their creditors.

The UK average household debt-to-income ratio has risen substantially in recent years, leading some to attribute the rise in insolvencies to excessive borrowing. However, the ratio of debt repayment costs to income has remained quite low, weakening this claim. Moreover, the rise in borrowing could itself be a reflection of a lower “fear” of bankruptcy - the destigmatisation effect again.

Canada Lands Company Limited (CLCL) is an arms length, self-financing Crown Corporation reporting to Parliament through the Minister of Transport, Infrastructure and Communities. The principal goal of the company’s current policy mandate as determined by Cabinet is:

“to ensure the commercially oriented, orderly disposition of surplus properties with optimal value to the Canadian taxpayer and the holding of certain properties.”

The Company is the parent of three wholly owned, active subsidiaries: Canada Lands Company CLC Limited, Old Port of Montreal Inc., and Parc Downsview Park Inc. The latter two companies report directly to Parliament, rather than through CLCL.

Pre Existing Duty Rule

The pre-existing duty rule is a legal concept relating to when the performance of a legal duty is classified as consideration.


Definition

Generally, performing a legal duty which is already owed does not constitute consideration, unless that duty is doubtful or honestly disputed.

In some states, parties may renegotiate contracts to include additional benefits if, for example, the party performs unexpected or additional duties, the parties assent in good faith, or the new contract is written. A new promise by the parties to an existing contract constitutes a mutual recission of the existing contract and the formation of a new one.


Exception

Where contractual parties owe each other existing contractual obligations, but a third party offers a promise contingent upon performance of the contract, that promise has sufficient consideration.

Microsoft Office Communicator is an integrated enterprise communications client, enabling information workers to communicate in real time through the use of instant messaging (IM), voice over Internet protocol (VoIP) and videoconferencing. Unlike Microsoft Office Outlook, its email counterpart, Office Communicator cannot be used as a standalone application but requires Microsoft Office Communications Server in order to be used. Communicator replaces Windows Messenger in corporate environments.

The current version is Office Communicator 2005. The next version, Office Communicator 2007, has been released to manufacturing (RTM) and will launch in October 2007.

Meteņi

In ancient Latvia, Meteņi was a festival celebrated on February 23. The primary attracton was feast which included all the parts of a pig, bread, barley and beer. The people also went sledding. The degree to which one celebrated Meteni was believed to be proportional to the success of one’s crops. Thus, farmers and their families danced vigorously to ensure a good harvest. The festival was sacred to Meteņis, who was said to arrive on a sleigh on this holiday.

United States bankruptcy court

The United States Bankruptcy Court is a federal court that has subject matter jurisdiction over bankruptcy cases. Bankruptcy cases cannot be filed in state court. Each of the 94 federal judicial districts handles bankruptcy matters.

The bankruptcy judges in each judicial district in regular active service constitute a “unit” of the applicable United States district court (see ). The bankruptcy judge is appointed for a term of 14 years by the United States court of appeals for the circuit in which the applicable district is located (see ).

Technically, the United States district courts have subject matter jurisdiction over bankruptcy matters (see ). However, each such district court may, by order, “refer” bankruptcy matters to the bankruptcy court (see ). As a practical matter, most district courts have a standing “reference” order to that effect, so that all bankruptcy cases in that district are handled, at least initially, by the bankruptcy court. In unusual circumstances, a district court may in a particular case “withdraw the reference” (i.e., take the case or a particular proceeding within the case away from the bankruptcy court and decide the matter itself) under .

The overwhelming majority of all proceedings in bankruptcy are held before a United States bankruptcy judge, whose decision in all matters is final, subject to appeals to the district judge or a Bankruptcy Appellate Panel (”BAP”) for review of the decision.

Arthur Gonzalez

The Hon. Arthur J. Gonzalez is a United States Bankruptcy Court Judge for the Southern District of New York. Gonzalez received his undergraduate degree from Fordham University in 1969. Following graduation, he worked as a New York City public school teacher until 1982. After earning a law degree, also from Fordham, Gonzalez became an attorney for the Manhattan District Counsel Office of the Internal Revenue Service (IRS). He left the IRS in 1988 and worked as a private lawyer for several firms. During this period, he earned a Master of Laws from New York University (NYU). In 1991, Gonzalez re-entered government to become an Assistant United States Trustee for the Southern District of New York. He was promoted in 1993 to become Trustee for New York, Connecticut, and Vermont. Judge Gonzalez was appointed Bankruptcy Judge in 1995.


Significant Cases

Gonzalez presided over the bankruptcy proceedings for WorldCom, the largest U.S. bankruptcy case, and Enron. Both cases resulted, at least in part, from egregious fraud by the companies prior to their filing for bankruptcy.

Jack Rowley

John Frederick “Jack” Rowley (October 7, 1920 – June 28, 1998) was an English football player. His younger brother Arthur still holds the record for the most number of goals scored in the Football League during a career with 434.

Rowley was purchased from Bournemouth & Boscombe by Manchester United for £3,000. He was a deadly striker, his nickname was The Gunner, in the 1940s and early 1950s. His first game for the club came in 1937 against Sheffield Wednesday. He helped United to the 1948 FA Cup and their 1952 championship. He retired in 1955 with 422 appearances for the club and 208 goals.
He later went on to manage Oldham Athletic, gaining promotion to the Third Division in 1963. From here, he went on to manage AFC Ajax for the 1963-64 season.

The airline ceased most flight operations in February 2006 and filed a Chapter 11 bankruptcy petition on February 21, 2006, but the petition was not immediately accepted by the court and its status and effect are not clear at this time.<ref>US Department of Transportation retrieved 16 May 2007</ref>

As of January 3, 2007, most of the telephone numbers on their web site have “disconnected” recordings. The one number that answers with a Florida Coastal Airlines recording says they are not currently providing any service. Some of the Florida Coastal Airlines fleet is stored with and being maintained by Lynx Airlines at Fort Lauderdale Hollywood International Airport. It is believed that Lynx Airlines will acquire the carrier from Bankruptcy.

Judgment debtor

Judgement Debtor, in English or American law, a person against whom a judgment ordering him to pay a sum of money has been obtained and remains unsatisfied. Such a person may be examined as to whether any and what debts are owing to him, and if the judgment debt is of the necessary amount he may be made bankrupt if he fails to comply with a bankruptcy notice (in US, Law, an involuntary petition) served on him by the judgment creditors.

In the past, the judgment debtor could have been committed to prison or have a receiving order made against him in a judgment summons under the Debtors Act 1869.

Jens of Sweden

Jens of Sweden was a Swedish company founded by Jens Nylander.
They mostly made portable media players.
Nylander declared the company bankrupt on 20 September 2005. According to Nylander, the company’s financial problems were mostly due to the bankruptcy of the American reseller Outwardsound, which left Jens of Sweden with claims of 700 000 Swedish kronor, and the Korean manufacturer Iops. Iops made the MP-130, but technical problems with the player forced Jens of Sweden to repair the players at a cost of approximately 3-4 million kronor. After this, the company canceled their payments to Iops.

Kaneko

Kaneko Seisakusho (also called Kaneko Co. Ltd.) was a video game publisher based in Suginami, Tokyo, Japan that published a number of games both under its brand and other companies, such as Air Buster, Shogun Warriors, DJ Boy, Guts’n, and the Gals Panic series. Although most of the games that Kaneko produced were standard arcade fare, they also earned a degree of notoriety for both DJ Boy (for its reputedly racist plot and negative stereotyping) and the Gals Panic series (the games often bordering on softcore pornography).

The last game released by the company was Gals Panic S3 for the Arcade in 2002. On August 12 2004 Kaneko filed for bankruptcy. Though the company’s founder, Hiroshi Kaneko vows to continue, as of 2006 an ongoing civil lawsuit threatens to officially close the company [1].

Linda Schrenko

Linda Schrenko is a former superintendent of schools in the U.S. state of Georgia who was convicted on an embezzlement scheme and sentenced to 8 years in prison.

Biography

Schrenko was born on July 24, 1949, in Millen, Georgia. She received a bachelor’s degree in education from Augusta College in 1972, after which she worked as a teacher and in other educational jobs until her election as superintendent.


As superintendent

In 1994, Schrenko, a Republican, defeated a Democratic incumbent to be elected as superintendent of schools, becoming the first woman elected to statewide office in Georgia, and was re-elected in 1998. She generated controversy by advocating the teaching of creationism in schools, and was often in conflict with Governor Roy Barnes.She also started harsh teacher criticisms with creating the Georgia Criterion Referenced Comptency Test.


Campaign for governor

In 2002, Schrenko sought the Republican nomination for governor of Georgia against Bill Byrne and current governor Sonny Perdue. Schrenko and Byrne were defeated by Perdue, who avoided a runoff by claiming a majority of the primary votes.


Legal problems

On November 10, 2004, Schrenko was indicted by a federal grand jury on charges stemming from her embezzlement of more than $600,000 in federal education funds. The indictment alleged that a substantial portion of the funds in question had been used to fund Schrenko’s campaign for governor and facial plastic surgery.

She pled guilty to fraud and money laundering, and was sentenced to 8 years in prison on July 12, 2006. She was also fined $414,000 in restitution, and will be required to serve 3 years probation and 100 hours of community service upon being released.

CJLM-FM

CJLM-FM is a French-language Canadian radio station located in Joliette, Quebec, about 40 kilometres northeast of Montreal.

It broadcasts on 103.5 MHz with an effective radiated power of 3,000 watts (class A) using an omnidirectional antenna. Since 1997, CJLM-FM is owned and operated by the “Coopérative de radiodiffusion MF 103,5 de Lanaudière”, a cooperative that was created to buy the station after the bankruptcy of the previous owner.

The station has an adult contemporary music format and identifies itself as “M 103,5 FM”. CJLM (as it was originally known) opened in April 1960 as an AM station on 1350 kHz, and moved to FM in 1996.
